msic.com.au, (the "Site") is an online service for providing Maritime Security Identification Cards, owned and operated by ClientView Pty. Ltd. Australia (ABN: 92 113 680 854).

Please read these terms of use carefully before using this site. By using this site you are agreeing to be bound by the following terms of use. If you choose not to be bound by the following terms of use then ClientView does not grant you the right to use this site and you must not use this site.

Variation

ClientView may vary these terms at any time. Any variations become effective on posting to this site. By continuing to use this Site after the terms have been varied you agree to be bound by the variation.

Use and copyright

You may use this Site and the information contained within it for your own personal and non-commercial reference only. You agree that you will not hack into this Site nor employ any robot, spider or other device or process to use this Site for any unauthorised purposes. You agree that you will not take any action that imposes an unreasonably large burden on this Site.

The information contained within this Site (including programming scripts, graphics and logos) are copyright of ClientView and its related bodies corporate. You may make any copies of any information reasonably incidental to your viewing of the Site and may retain a single permanent copy for your personal reference. The information may not otherwise be used, copied, reproduced, published, stored in a retrieval system, altered, transmitted in any form or by any means in whole or in part (except where by law such use cannot be prohibited) without the prior written approval of ClientView or its related bodies corporate.

Trademarks

The trademarks appearing on this Site are primarily trademarks of ClientView, or its affiliates. Other trademarks displayed on this Site are trademarks of their respective owners. Nothing contained on this Site should be construed as granting any licence or right of use of any trademark displayed on the Site without the express written permission of ClientView, or its relevant affiliate, or third party owner.

Refunds and cancellations

Your rights under the Australian Consumer Law. Nothing in this policy excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law. If our service fails to meet a consumer guarantee you may be entitled to a remedy, and to compensation for any other reasonably foreseeable loss or damage. This policy sets out what we offer in addition to those rights, not instead of them.

What your payment covers. The amount you pay ClientView has two parts. The first is the AusCheck background check fee, which we collect from you and pass on to AusCheck, the Australian Government agency that conducts the check. The second is ClientView's service fee, which covers preparing your application, checking your documents, arranging your identity verification, lodging your application with AusCheck, and issuing and posting your card.

Cancelling before we lodge your application. You may cancel at any time before we lodge your application with AusCheck. We will refund what you have paid, less an administration fee of $40 excluding GST ($44 including GST) for each applicant, which covers the work already carried out on that application. If we are unable to lodge your application for a reason within our control, no administration fee applies. To cancel, email info@msic.com.au or phone 1300 855 960 and give us your name and your application reference.

After we lodge your application. Once your application has been lodged with AusCheck we cannot refund it, whatever the outcome. At lodgement we incur substantial costs that we cannot recover, including the AusCheck background check fee, which is payable whether or not a card is issued.

If AusCheck refuses your application. A refusal is a decision of the Australian Government, not of ClientView. AusCheck refunds its own fee only in the limited circumstances set out in its published refund policy, and any application for that refund is made directly to AusCheck on its refund form. ClientView's service fee is not refunded after lodgement, because the work it pays for has been done. We will explain what the decision means for you and what your options are, including any right to have it reviewed.

How refunds are paid. Approved refunds are paid to the account or card used for the original payment, normally within 10 business days of approval.

Limitation of Liability

To the extent permitted by law our aggregate liability to you, whether for breach of these terms or in negligence or in any other tort or for any other common law or statutory cause of action arising in relation to these terms, this Site or the content available through this Site is limited to A$100. To the extent permitted by law we will not be liable for any direct, incidental, consequential or indirect damages, loss or corruption of data, loss of profits, goodwill, bargain or opportunity or loss of anticipated savings resulting from your access to, or use of, or inability to use this Site and its content, whether based in contract, tort, negligence, statute or any other legal theory, and whether or not we know of the possibility of such damage. If a jurisdiction does not allow the exclusion or limitation of liability in accordance with the foregoing, but allows a limitation of a certain maximum extent then our liability is limited to that extent.

General Provisions

If any part of this agreement is held to be unenforceable, the unenforceable part must be given effect to the greatest extent possible and the remainder will remain in full force and effect. This agreement is governed by the laws of New South Wales, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of New South Wales, Australia.
