msic.com.au, (the "Site") is an online service for providing Maritime Security Identification Cards, owned and operated by ClientView Pty. Ltd. Australia (ABN: 92 113 680 854).

ClientView Pty Ltd (ClientView, we, us) operates msic.com.au and the online MSIC application portal at msic.au. We are an Issuing Body for the Maritime Security Identification Card (MSIC) scheme, approved by the Department of Home Affairs. This policy explains how we collect, use, hold and disclose your personal information, and how you can access it, correct it or make a complaint. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

What we collect

To process an MSIC application we collect: your name, date of birth, contact details and residential address history; copies and details of your identity documents (the Category A to D documents required under the Maritime Transport and Offshore Facilities Security Regulations 2003); evidence of your operational need, usually a letter from your employer; evidence of your entitlement to work in Australia, if you are not an Australian citizen; and payment details for your application.

We do not collect your criminal history as part of your application. The background check is conducted by AusCheck, and any information about criminal history is assessed by AusCheck and its partner agencies, not by us. AusCheck advises us only of the outcome of your check.

There is one exception, set by the Regulations. If you hold, or have applied for, an MSIC and are convicted of and sentenced for a maritime security relevant offence, regulation 6.08LB requires you to notify us or the Department of Home Affairs in writing within 7 days. If you notify us, we must apply to AusCheck for a new background check within 2 working days. We handle that notification only to meet this obligation; the assessment itself remains AusCheck's.

If you browse our website without applying, we collect limited technical information (such as IP address, browser type, pages visited and time of access) that does not identify you on its own.

How we collect it

We collect personal information directly from you: through the application forms on msic.au, by phone, by email, or during an assisted application appointment if you choose our Silver or Gold service. We also collect information from third parties where the scheme requires it: from your employer, to confirm your operational need; from Australia Post or your approved workplace verifier, to confirm your identity documents were verified; and from AusCheck, which advises us of the outcome of your background check.

Why we collect it

We collect, hold and use your personal information to: process your MSIC application and lodge your background check with AusCheck; verify your identity as the scheme requires; print, deliver, renew, replace, suspend or cancel your MSIC; keep you informed of your application's progress by SMS and email; provide customer support; meet our record-keeping and reporting obligations as an Issuing Body; and send you service updates relating to MSIC requirements, such as renewal reminders. You can opt out of reminder communications at any time; we do not send unsolicited advertising.

Who we disclose it to

We disclose personal information only as needed to deliver the MSIC service or as the law requires:

AusCheck (Department of Home Affairs). As an Issuing Body we must apply to AusCheck for a background check on every applicant. AusCheck's assessment involves the Australian Criminal Intelligence Commission (criminal history), the Australian Security Intelligence Organisation (security assessment) and immigration authorities (work entitlement). AusCheck handles your information under the AusCheck Act 2007 and its own privacy arrangements.

Australia Post or your approved workplace verifier, for identity verification, and Australia Post again for registered post delivery of your card.

Our payment provider, to process your payment securely. We do not store full card numbers on our systems.

Government agencies and regulators, where the Maritime Transport and Offshore Facilities Security Act 2003 and Regulations require it, including transfer of MSIC records to a successor Issuing Body or to the Department if our role as an Issuing Body ever changes.

We do not sell personal information, and we do not disclose it overseas. Your information is stored on servers located in Australia.

How we hold and protect it

Your information is held on secure Australian servers. Information passing between your browser and our systems is protected by encryption in transit (TLS). Our security arrangements are independently audited each year. Access to applicant records is restricted to staff who need it to process applications, and we take reasonable steps to protect personal information from misuse, interference, loss, unauthorised access, modification and disclosure.

As an MSIC Issuing Body we are required by the Regulations to retain application records for prescribed periods. When information is no longer required, we take reasonable steps to destroy or de-identify it.

If a data breach occurs that is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner in accordance with the Notifiable Data Breaches scheme.

Cookies and website analytics

Our website uses cookies to keep the site working properly and to understand how visitors use it, which helps us improve it. You can set your browser to refuse cookies or alert you when cookies are being used; the application portal may not function correctly with cookies disabled.

Access, correction and complaints

You can ask for access to the personal information we hold about you, and ask us to correct it, by contacting us using the details below. We will respond within a reasonable time and will not charge you for making a request. If we refuse a request, we will tell you why in writing.

If you believe we have mishandled your personal information, contact us first and we will investigate and respond to you. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or 1300 363 992.
